美國最高法院大法官史卡利亞(Antonin Scalia)2月驟逝，歐巴馬總統依法在3月提出中間派法官賈蘭德為繼任人選，並要求國會就此進行聽證和表決。但共和黨人主張，即將於明年1月卸任的歐巴馬，應把提名權留給下任總統。
